What is the maximum allowed payment term?

In Belgium as in France, 60 days maximum between companies (or 45 days end of month in France if the contract so provides). Without a mention, the default term is 30 days.

Is the €40 indemnity automatic?

Yes, it is due automatically for each unpaid invoice, in Belgium as in France. If your actual recovery costs are higher, the difference can be claimed with supporting documents.
